Behavioral Activation App Terms of Use

Effective date: October 24, 2026

These Terms of Use cover the Behavioral Activation app for iPhone, iPad, and Android. They are an agreement between you and Everyday Insight LLC, a California limited liability company. Here, “we” and “us” mean Everyday Insight LLC. The mybehavioralactivation.com website has its own terms at mybehavioralactivation.com/terms.

1. Agreeing to these terms

By accepting these terms in the app, or by using the app, you agree to these terms and to the app’s Privacy Policy, which is part of them. If you don’t agree, please don’t use the app.

2. What Behavioral Activation is

Behavioral Activation is a planner for activities, with educational articles. You can write what matters to you in five areas of life, keep a list of activities, plan them for specific days, and afterward record whether you did them and rate how much you enjoyed each one and how much you felt you accomplished. Looking back at the week and Patterns show what got done and what got in the way. You can also write about times you notice you’re avoiding something and what to try instead, keep a plan for keeping it going, and make a report to share with a therapist.

It is a structured way to reflect, for education and personal use.

3. Not therapy, medical care, or crisis support

The app does not provide therapy, counseling, medical care, assessment, diagnosis, treatment, crisis services, or emergency support, and it is not a substitute for care from a qualified professional. It is not a medical device.

Using the app or contacting us does not create a therapist and client relationship, or any other professional or fiduciary relationship, with Everyday Insight LLC or any person. Nothing in the app is advice directed at you or your situation.

If you work with a therapist, psychiatrist, physician, or other clinician, we encourage you to share what you do in the app with them and to follow their guidance where it differs from anything in the app.

4. Using the app at your own risk

Planning activities and looking closely at how they went can bring up unwanted feelings, especially when plans don’t happen or when what you notice about your days is hard to face. The app’s counts, averages, and lists are simple summaries of what you entered. They can be wrong or incomplete, and they aren’t a diagnosis.

The activities you choose, and how you do them, are your own call and your own risk. Choose what’s safe for you, and if you have health limits, check with a doctor before activities that take physical effort. Go at your own pace, and stop whenever it feels like too much. Reminders are best effort and may not arrive, so don’t rely on them for anything important. If your mood stays low or gets worse, please talk with a professional.

You alone decide what to write, what to do, and when to stop. You use the app at your own risk. To the fullest extent the law allows, Everyday Insight LLC is not responsible for any discomfort, distress, injury, loss, or other harm arising from your use of the app or from anything you do or don’t do because of it. If a clinician has advised you against something, don’t use the app to do it.

5. About Behavioral Activation

Behavioral Activation helps you plan activities and reflect on how they went. It doesn’t diagnose or treat depression or any other condition, and it isn’t a substitute for an evaluation or care from a professional. The counts and averages in Looking back at the week, Patterns, and the report, and the lists of activities rated highest, are simple summaries of what you entered. When the app shows your activities beside your end-of-day mood, it shows what happened on the same days, not what caused what. The app never tells you whether you’re depressed or whether you’re improving.

Activity ideas, and the activities suggested when you’re short on energy, are examples, not advice for you or your situation. Stop any activity, or take a break from the app, whenever it feels like too much.

The page When I notice I’m avoiding something isn’t meant for avoidance tied to strong fear, panic, or trauma. That kind of avoidance is for work with a therapist.

Reminders and the widget don’t show anything you wrote unless you turn on Show activity names in Settings. With it on, activity names can appear on your Lock Screen and in the widget, where other people may see them.

Add to Calendar hands the event to your device’s calendar app. Once you save it there, the calendar app and the account it uses hold the event under their own terms, and changing or deleting the plan in Behavioral Activation doesn’t change it.

Behavioral Activation is made for adults. Talk with a doctor or a mental health professional if low mood has lasted more than two weeks, is getting worse, or makes it hard to take care of yourself or others. If you have bipolar disorder, plan big changes in your activity and sleep with your clinician. If you’re having thoughts of suicide, get help now. The next section says where to call.

6. If you are in crisis

The app is not a crisis service, and nobody monitors what you write in it.

In an emergency, call 911 or your local emergency number. If you are in crisis in the United States, call or text 988. For Spanish, call 988 and press 2, or text AYUDA to 988. In Mexico, call Línea de la Vida at 800 911 2000.

7. Age

Behavioral Activation is not intended for children under 13. If you are under 18, use it only with the involvement and permission of a parent or legal guardian.

8. Cost

The app is free. It has no subscriptions, in-app purchases, paid features, or ads, and no account is needed.

9. Your license to use the app

We give you a personal, non-exclusive, non-transferable, revocable license to use the app for your own reflection and, if you are a clinician or educator, with the people you work with. We may suspend or end this license if the app is used in breach of these terms.

10. If you are a clinician or educator

You are welcome to use the app in your work. Doing so is your professional decision, and these terms don’t change what you already owe your clients or students.

You remain responsible for your own judgment, for whether this exercise suits a particular person, for your professional, ethical, and licensing obligations, and for any consent a client should give. We have no relationship with your clients and no view into how the app is used.

The app is not a HIPAA-covered service. We are not a business associate, and we won’t enter into a business associate agreement. Don’t use the app to collect, send, or store protected health information for your practice.

11. What you create stays yours

What you write in the app belongs to you. We claim no ownership of it and no license to it. We don’t receive it either, because the app has no accounts and no server of ours. The Privacy Policy explains how the app stores your data.

Because your data is on your device and in your own accounts, keeping it safe is up to you. Deleting the app, losing your device, or removing the synced copy can erase it, and we can’t recover it for you.

12. Methods, sources, and credit

Behavioral activation is a long-established method, used on its own and as part of cognitive behavioral therapy, and taught and published in many versions. Many versions, including ours, follow the same basic steps: naming what matters to you, choosing activities that fit, starting with easier ones, planning them for specific days, and looking at how they went. The prompts, articles, activity ideas, worked examples, and layout of the app were written for Everyday Insight.

The value words in What matters to me come from the Personal Values Card Sort by W. R. Miller, J. C’de Baca, D. B. Matthews, and P. L. Wilbourne, University of New Mexico, 2001, which is in the public domain. Everyday Insight LLC is not affiliated with its authors.

13. Our content and using our materials

Everyday Insight LLC or its licensors own the copyright and other rights in the app, its design, code, writing, and examples, and in the layout of the documents it creates. What you write in those documents stays yours. You may use the app and what it exports for yourself and, if you are a clinician or educator, with the people you work with.

You may not sell the app or its materials, charge for access to them, include them in a product you sell, or remove the Everyday Insight name or source credits from copies you share. Any other use needs our written permission, which you can ask for at hello@mybehavioralactivation.com.

14. Acceptable use

Don’t copy, resell, or redistribute the app, reverse engineer it except where the law allows, use it to break the law or harm anyone, or try to interfere with it.

15. Sync, app stores, and other services

If you turn on sync, your data is stored in your own iCloud account or Google Drive. Those services are run by Apple and Google, not by us, and their terms and privacy policies apply. The app is distributed through the App Store and Google Play, whose own terms also apply. Links in the app lead to websites we don’t control, and linking to them isn’t an endorsement.

16. Availability and changes

We may change, suspend, or stop any part of the app, including sync and reminders, at any time.

17. Disclaimer of warranties

The app is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability. We don’t promise that the app will be uninterrupted or error-free, or that using it will improve any health or wellness outcome. Some jurisdictions don’t allow certain warranties to be excluded, so some of this may not apply to you.

18. Limitation of liability

To the fullest extent the law allows, Everyday Insight LLC and its owners, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of, or inability to use, the app.

Because the app is free, and to the fullest extent the law allows, our total liability for any claim relating to the app or these terms will not exceed one hundred US dollars. Nothing in these terms limits liability that the law does not allow to be limited, including liability for gross negligence, fraud, or willful misconduct.

19. Indemnification

You agree to indemnify and hold harmless Everyday Insight LLC and its owners, employees, and licensors from claims, damages, liabilities, and expenses, including reasonable attorneys’ fees, arising from your misuse of the app or your violation of these terms or the law. If you use the app with clients, this includes claims brought by them. It doesn’t apply to harm caused by our own misconduct.

20. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules, except where the consumer protection laws of your home jurisdiction provide otherwise.

Before filing a claim, please contact us at hello@mybehavioralactivation.com and give us at least 30 days to try to resolve the dispute informally. If we can’t, any dispute arising out of or relating to these terms or the app will be brought only in the state or federal courts located in California, and both you and we consent to their jurisdiction. Either of us may still bring a qualifying claim in small claims court or seek an injunction to protect intellectual property rights.

21. Changes to these terms

We may update these terms. When we do, we’ll post the new version at mybehavioralactivation.com/app/terms with a new effective date, and the app will ask you to accept it the next time you open it.

22. Language

These terms are available in English and Spanish. If the two versions differ, the English version controls.

23. General

If any part of these terms is found unenforceable, the rest stays in effect. If we don’t enforce a provision, that isn’t a waiver of it. You may not transfer your rights under these terms. We may transfer ours to a successor, for example if Everyday Insight LLC is sold or reorganized. The sections on not providing care, use at your own risk, what you create, our content, warranties, liability, indemnification, and governing law continue after you stop using the app. These terms and the Privacy Policy are the entire agreement between you and us about the app.

24. Additional terms for the App Store

These apply to the app on iPhone and iPad.

25. Additional terms for Google Play

If you got the app from Google Play, the Google Play Terms of Service also apply. Google is not a party to these terms and is not responsible for the app or its content.
